ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਬੀਤੇ ਸੋਮਵਾਰ ਨੂੰ ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ਸਖ਼ਤ ਆਲੋਚਨਾ ਕੀਤੀ ਅਤੇ ਸੂਬੇ ਦੇ ਐਡਵੋਕੇਟ ਜਨਰਲ ਨੂੰ ਇਹ ਹਦਾਇਤ ਕੀਤੀ ਹੈ ਕਿ ਉਹ ਸਰਕਾਰੀ ਵਕੀਲਾਂ ਦੀ ਅਦਾਲਤ ਵਿੱਚ ਹਾਜ਼ਰੀ ਨੂੰ ਯਕੀਨੀ ਬਣਾਉਣ।

 ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਪੰਜਾਬ ਸਰਕਾਰ ਦੇ ਵਕੀਲਾਂ ਦੀ ਜ਼ਿਆਦਾਤਰ ਗੈਰਹਾਜ਼ਰੀ ‘ਤੇ ਨਾਰਾਜ਼ਗੀ ਜ਼ਾਹਰ ਕੀਤੀ ਹੈ ਅਤੇ ਇਹ ਕਿਹਾ ਕਿ ਸੂਬੇ ਦੇ ਪੈਨਲ ਵਕੀਲ ਨੋਟਿਸ ਜਾਰੀ ਹੋਣ ਦੇ ਬਾਵਜੂਦ ਵੀ ਪੇਸ਼ ਨਹੀਂ ਹੋ ਰਹੇ ਹਨ।

ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਇਸ ਮਾਮਲੇ ਤੇ ਸਖ਼ਤ ਟਿੱਪਣੀ ਕਰਦਿਆਂ ਕਿਹਾ ਕਿ ਇਹ ਰੋਜ਼ਾਨਾ ਦਾ  ਹੀ ਡਰਾਮਾ ਬਣ ਗਿਆ ਹੈ। ਦਰਅਸਲ, ਜਸਟਿਸ ਜੇ.ਕੇ. ਮਹੇਸ਼ਵਰੀ ਅਤੇ ਅਰਵਿੰਦ ਕੁਮਾਰ ਦੇ ਬੈਂਚ ਨੇ ਇਹ ਟਿੱਪਣੀ ਪੰਜਾਬ ਸਰਕਾਰ ਦੀ ਪਟੀਸ਼ਨ ‘ਤੇ ਸੁਣਵਾਈ ਕਰਦਿਆਂ ਹੋਇਆਂ ਕੀਤੀ ਹੈ, ਜਿਸ ਵਿੱਚ ਸ਼੍ਰੋਮਣੀ ਅਕਾਲੀ ਦਲ ਦੇ ਆਗੂ ਅਤੇ ਸਾਬਕਾ ਮੰਤਰੀ ਬਿਕਰਮਜੀਤ ਸਿੰਘ ਮਜੀਠੀਆ ਨੂੰ 10 ਅਗਸਤ, 2022 ਨੂੰ ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਹਾਈ ਕੋਰਟ ਵੱਲੋਂ ਦਿੱਤੀ ਗਈ ਜ਼ਮਾਨਤ ਨੂੰ ਚੁਣੌਤੀ ਦਿੱਤੀ ਗਈ ਸੀ।

ਅਦਾਲਤ ਨੇ ਕਿਹਾ- ਇਹ ਰੋਜ਼ਾਨਾ ਦਾ ਡਰਾਮਾ ਬਣ ਗਿਆ ਹੈ

ਹਿੰਦੁਸਤਾਨ ਟਾਈਮਜ਼ ਦੀ ਇੱਕ ਰਿਪੋਰਟ ਦੇ ਅਨੁਸਾਰ ਅਦਾਲਤ ਨੇ ਇਹ ਕਿਹਾ ਕਿ, “ਪੰਜਾਬ ਦੇ ਐਡਵੋਕੇਟ ਜਨਰਲ, ਅਸੀਂ ਤੁਹਾਨੂੰ ਪਹਿਲਾਂ ਇੱਕ ਮਾਮਲੇ ਵਿੱਚ ਸੰਮਨ ਕੀਤਾ ਸੀ। ਤੁਹਾਡੇ ਸੂਬੇ ਵਿੱਚ, ਸਰਕਾਰ ਦੇ ਵਕੀਲ ਨੋਟਿਸ ਦੇ ਬਾਵਜੂਦ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਪੇਸ਼ ਨਹੀਂ ਹੋ ਰਹੇ ਹਨ। ਅਸੀਂ ਪਹਿਲਾਂ ਹੀ ਦੋ ਆਦੇਸ਼ਾਂ ਵਿੱਚ ਇਸ ‘ਤੇ ਟਿੱਪਣੀ ਕਰ ਚੁੱਕੇ ਹਾਂ। ਇਹ ਇੱਕ ਰੋਜ਼ਾਨਾ ਡਰਾਮਾ ਬਣ ਗਿਆ ਹੈ। ਪੰਜਾਬ ਸਰਕਾਰ ‘ਗੈਰਹਾਜ਼ਰ’ ਦਾ ਸਮਾਨਾਰਥੀ ਬਣ ਗਈ ਹੈ। ਇਹ ਸਿਰਫ਼ ਅਪਰਾਧਿਕ ਮਾਮਲਿਆਂ ਤੱਕ ਸੀਮਤ ਨਹੀਂ ਹੈ, ਸਗੋਂ ਸਿਵਲ ਮਾਮਲਿਆਂ ਵਿੱਚ ਵੀ ਅਜਿਹਾ ਹੀ ਹੋ ਰਿਹਾ ਹੈ। ਕੋਈ ਵੀ ਪੇਸ਼ ਨਹੀਂ ਹੋ ਰਿਹਾ।”

ਸਰਕਾਰ ਨੇ ਮੰਗਿਆ ਸਮਾਂ, ਐਡਵੋਕੇਟ ਜਨਰਲ ਨੇ ਮੁਆਫ਼ੀ ਮੰਗੀ

ਪੰਜਾਬ ਸਰਕਾਰ ਵੱਲੋਂ ਹੋਰ ਸਮਾਂ ਮੰਗਣ ਤੋਂ ਬਾਅਦ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਸਰਕਾਰ ਦੀ ਪਟੀਸ਼ਨ ‘ਤੇ ਸੁਣਵਾਈ ਦੋ ਹਫ਼ਤਿਆਂ ਲਈ ਮੁਲਤਵੀ ਕਰ ਦਿੱਤੀ ਹੈ। ਇਸ ਦੌਰਾਨ, ਪੰਜਾਬ ਦੇ ਐਡਵੋਕੇਟ ਜਨਰਲ ਗੁਰਮਿੰਦਰ ਸਿੰਘ ਨੇ ਅਦਾਲਤ ਤੋਂ ਮੁਆਫੀ ਵੀ ਮੰਗੀ ਹੈ ਅਤੇ ਇਹ ਭਰੋਸਾ ਵੀ ਦਿੱਤਾ ਹੈ ਕਿ ਭਵਿੱਖ ਵਿੱਚ ਅਜਿਹੀ ਗਲਤੀ ਨਹੀਂ ਦੁਹਰਾਈ ਜਾਵੇਗੀ।


ਮਜੀਠੀਆ ਨੂੰ ਡਰੱ/ਗਜ਼ ਮਾਮਲੇ ਵਿੱਚ ਕੀਤਾ ਸੀ ਤਲਬ

ਇਸ ਮਾਮਲੇ ਵਿੱਚ, ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਪਹਿਲਾਂ ਮਜੀਠੀਆ ਨੂੰ ਵਿਸ਼ੇਸ਼ ਜਾਂਚ ਟੀਮ (SIT) ਦੇ ਮੁੱਖ ਦਫ਼ਤਰ, ਪਟਿਆਲਾ ਦੇ ਵਿੱਚ ਪੇਸ਼ ਹੋਣ ਦਾ ਨਿਰਦੇਸ਼ ਜਾਰੀ ਕੀਤਾ ਸੀ। ਐਸ.ਆਈ.ਟੀ ਮਜੀਠੀਆ ਵਿਰੁੱਧ ਡਰੱਗਜ਼ ਮਾਮਲੇ ਦੀ ਜਾਂਚ ਕਰ ਰਹੀ ਹੈ। ਪੰਜਾਬ ਸਰਕਾਰ ਨੇ ਅਦਾਲਤ ਵਿੱਚ ਦੋਸ਼ ਲਗਾਇਆ ਸੀ ਕਿ ਮਜੀਠੀਆ ਜਾਂਚ ਦੇ ਵਿੱਚ ਸਹਿਯੋਗ ਨਹੀਂ ਕਰ ਰਿਹਾ।


ਜ਼ਮਾਨਤ ‘ਤੇ ਹਾਈ ਕੋਰਟ ਨੇ ਕੀ ਕਿਹਾ?

ਮਜੀਠੀਆ ਨੇ ਆਪਣੇ ਖਿਲਾਫ ਹੋਈ ਕਾਰਵਾਈ ਨੂੰ ਇੱਕ ਰਾਜਨੀਤਿਕ ਅਤਿਆਚਾਰ ਦੱਸਿਆ ਸੀ ਅਤੇ ਅਦਾਲਤ ਨੂੰ ਪੁੱਛਗਿੱਛ ਲਈ ਤਰੀਕਾਂ ਨਿਰਧਾਰਤ ਕਰਨ ਦੀ ਬੇਨਤੀ ਵੀ ਕੀਤੀ ਸੀ। ਹਾਈ ਕੋਰਟ ਨੇ ਆਪਣੇ ਹੁਕਮ ਵਿੱਚ ਕਿਹਾ ਸੀ ਕਿ “ਇਹ ਮੰਨਣ ਦਾ ਕੋਈ ਠੋਸ ਆਧਾਰ ਨਹੀਂ ਹੈ ਕਿ ਉਹ ਅਪਰਾਧ ਦੇ ਦੋਸ਼ੀ ਹਨ”, ਪਰ ਇਹ ਟਿੱਪਣੀ ਸਿਰਫ਼ ਜ਼ਮਾਨਤ ਪਟੀਸ਼ਨ ਦੇ ਸੰਦਰਭ ਵਿੱਚ ਹੀ ਸੀ। ਅਦਾਲਤ ਨੇ ਕਿਹਾ ਕਿ ਹੇਠਲੀ ਅਦਾਲਤ ਨੂੰ ਸੁਤੰਤਰ ਤੌਰ ‘ਤੇ ਅੱਗੇ ਵਧਣਾ ਚਾਹੀਦਾ ਹੈ।


2018 ਦੀ STF ਰਿਪੋਰਟ ਦੇ ਆਧਾਰ ‘ਤੇ ਕੇਸ

ਇਸ ਮਾਮਲੇ ਦੇ ਵਿੱਚ ਬਿਕਰਮਜੀਤ ਸਿੰਘ ਮਜੀਠੀਆ ਨੇ ਪਟਿਆਲਾ ਜੇਲ੍ਹ ਵਿੱਚ ਪੰਜ ਮਹੀਨੇ ਤੋਂ ਵੱਧ ਸਮਾਂ ਬਿਤਾਇਆ ਹੈ। ਮਜੀਠੀਆ ਸ਼੍ਰੋਮਣੀ ਅਕਾਲੀ ਦਲ ਦੇ ਪ੍ਰਧਾਨ ਸੁਖਬੀਰ ਸਿੰਘ ਬਾਦਲ ਦੇ ਸਾਲੇ ਅਤੇ ਸਾਬਕਾ ਕੇਂਦਰੀ ਮੰਤਰੀ ਹਰਸਿਮਰਤ ਕੌਰ ਬਾਦਲ ਦੇ ਭਰਾ ਹਨ। ਮਜੀਠੀਆ ਦੇ ਵਿਰੁੱਧ ਇਹ ਮਾਮਲਾ 2018 ਵਿੱਚ ਬਣਾਈ ਗਈ ਨਸ਼ਾ ਵਿਰੋਧੀ ਸਪੈਸ਼ਲ ਟਾਸਕ ਫੋਰਸ (STF) ਦੀ ਰਿਪੋਰਟ ਦੇ ਆਧਾਰ ‘ਤੇ ਦਰਜ ਕੀਤਾ ਗਿਆ ਸੀ। ਇਹ ਰਿਪੋਰਟ ਡਰੱਗ ਰੈਕੇਟ ਦੇ ਮੁਲਜ਼ਮਾਂ - ਜਗਜੀਤ ਸਿੰਘ ਚਾਹਲ, ਜਗਦੀਸ਼ ਸਿੰਘ ਭੋਲਾ ਅਤੇ ਮਨਿੰਦਰ ਸਿੰਘ ਔਲਖ - ਦੁਆਰਾ ਇਨਫੋਰਸਮੈਂਟ ਡਾਇਰੈਕਟੋਰੇਟ (ਈਡੀ) ਨੂੰ ਦਿੱਤੇ ਗਏ ਇਕਬਾਲੀਆ ਬਿਆਨਾਂ ‘ਤੇ ਅਧਾਰਤ ਸੀ।

On Monday, the Supreme Court strongly criticised the Punjab government for the absence of its lawyers in court, directing the state’s Advocate General to ensure their presence. The court expressed dissatisfaction, noting that despite notices being issued, the state's panel lawyers were not showing up. The Supreme Court remarked that this issue had turned into a "daily drama."


This comment came during a hearing of a petition filed by the Punjab government, which challenged the bail granted to Shiromani Akali Dal leader and former minister Bikram Singh Majithia by the Punjab and Haryana High Court on August 10, 2022. Justices J.K. Maheshwari and Arvind Kumar, who were presiding over the case, expressed frustration, saying the absence of the state’s lawyers had become a routine occurrence. "This has become a daily drama. The Punjab government has become synonymous with ‘absent.’ It is not only happening in criminal cases, but also in civil cases," the court observed.


In response, the Punjab government sought more time, and the court adjourned the hearing of its petition for two weeks. Meanwhile, Punjab’s Advocate General Gurminder Singh apologised to the court and assured that such an issue would not arise again in the future.


Previously, the Supreme Court had ordered Majithia to appear before the Special Investigation Team (SIT) in Patiala, which is investigating his involvement in a drugs case. The Punjab government had alleged that Majithia was not cooperating with the investigation.


Regarding Majithia’s bail, the High Court had ruled that there was no substantial evidence to suggest his guilt, but it made clear that this decision was only relevant to the bail plea, leaving the trial court to proceed independently. Majithia had argued that the charges against him were politically motivated and sought fixed dates for questioning.


The case is based on a 2018 report by the Special Task Force (STF) on narcotics. Majithia spent over five months in Patiala Jail after the report was filed, which was based on confessional statements from individuals involved in a drug racket, including Jagjit Singh Chahal, Jagdish Singh Bhola, and Maninder Singh Aulakh. Majithia is related to senior leaders of the Shiromani Akali Dal, including President Sukhbir Singh Badal and former Union Minister Harsimrat Kaur Badal.
